Condos and Marijuana: What Should You Expect ?

Live in a Condo or thinking of buying one? How does Marijuana becoming legal impact shared walls and spaces.

Under the federal Cannabis Act, Canadians will be legally permitted to buy, possess, use and share up to 30 grams of cannabis, and to grow up to four marijuana plants at home as of October 17th 2018.

Did you know that this right to use cannabis is not unrestricted?

Condo owners and tenants in condo complexes may still be subject to non-smoking rules.

These are designed to protect fellow owners and residents from unwanted second hand smoke.

Under the Condo Act, 1997,  Condo Corps are entitled to make and enforce these rules to “promote the safety, security and welfare” of the owners and property.

They also have a duty to stop “unreasonable interference with the enjoyment” of the units and common elements.

These rules can potentially ban any kind of smoking in common areas. They may even ban smoking in the units themselves.
